We have an inspection contingency clause that states we can back out with a major defect.

Our inspector marked the roof as marginal because it has some significant problems but is not leaking. We see that as a major defect, but the seller does not.

They claim that the roof is older, so we should not be surprised, even though they marked on the disclosure form that the roof was in good working order. If we back out, can we get our money back?
